For students residing in a different state, should discuss the differences with their insurance provider and should consider enrolling in a plan for the duration of their stay.
Residents for Delaware for 30 Days
Before applying for a Delaware medical card, applicants must be a resident of Delaware for 30 consecutive days. The state previously required a separate application form for those under 18 years of age or the certification of a pediatric specialist, but this was removed by SB24. In order to obtain a medical marijuana card in Delaware, patients must contact a primary care physician to discuss the requirements. While most physicians are willing to fill out a Physician Certification form for their patients, it’s important to remember that physicians are not required to recommend marijuana to their patients.
The Physician to Recommend the Card
Once a patient meets all the requirements, the next step is to find a qualified physician to recommend the card for them. A doctor must assess the patient’s medical history and recommend that the patient use medical marijuana for a qualifying condition. Once a qualified physician provides a recommendation, the patient must complete the rest of the application packet, which includes two pages of demographic information and a Medical Release Form. The applicant must submit the application within 90 days of receiving the recommendation.
Operate on a Non- Profit Basis
Patients in Delaware must visit a registered compassion center to obtain a medical card. These clinics must operate on a non-profit basis. They cannot provide more than three ounces of cannabis in a 14-day period and cannot employ anyone under the age of 21. Once a patient is registered with a dispensary, they must use that particular facility. Fortunately, the cannabis community is full of compassionate, helpful individuals who want to help.
Out-Of-State Medical Card
Patients may renew their card in Delaware, but they must submit the application to a department that accepts out-of-state medical cards. The card is valid for one year and needs to be renewed annually. During this time, a patient or caregiver should not cultivate marijuana at home. They should only consume marijuana in public places if they are undergoing legitimate treatment. The law prohibits marijuana consumption and home cultivation in public areas.
Medical Marijuana is Legal in Delaware
In addition to these benefits, medical marijuana is legal in Delaware. It is also legal to possess up to six ounces of marijuana. A patient with a medical marijuana card may purchase a variety of products. In addition, a medical cannabis card will allow them to possess up to 175 grams of the drug at a time. Unlike recreational use of marijuana, however, state law still prohibits possession of up to an ounce of the drug. A felony conviction will mean jail time depending on how much of the plant is possessed.
Prohibition to Cultivate Marijuana at Home
The state law does not allow patients to cultivate marijuana at home. Instead, they must obtain the medicine through a compassion center. These compassion centers are state-regulated facilities that cultivate medical marijuana for patients. These centers must undergo background checks and inspections before they can sell it. In addition, they must not advertise their services or share their office space with physicians. Selling medical marijuana is considered a felony under Delaware law. If caught, the state law will punish a person with a felony for two years in prison and a fine of $2,000.
Possess Up to Six Ounce of Medical Marijuana
The state law allows people to possess up to six ounces of medical marijuana. A caregiver can serve up to five patients with their medical card and pick up medicine for a homebound patient. In 2022, the state will begin allowing adults to use cannabis for recreational purposes. Then, the state will charge a 20% excise tax on all purchases made by adults over 21. This tax will apply to medical marijuana products as well as adult-use cannabis, but the state has not yet passed legislation on this issue.
Medical Marijuana is Illegal in Delaware
Medical marijuana in Delaware is illegal. The state is currently in a transitional period between medical marijuana and recreational marijuana. The law does not allow for the sale of marijuana or any other drugs. In order to enjoy the benefits of a medical marijuana card, it must be prescribed by a doctor. The law also allows for the possession of up to six ounces of marijuana by physicians who have a medical marijuana card. HB 110 has been passed by the House Revenue and Finance Committee and is pending action in the Senate Appropriations Committee.
